1. Introduction and Acceptance

Welcome to ELITE.GAMES, Nigeria's premier electronic raffle and auction platform. These Terms of Service constitute a legally binding agreement between you and ELITE.GAMES (referred to as "we," "us," or "our") governing your access to and use of our platform, including our website, mobile applications, and all related services. By creating an account, purchasing tickets, participating in raffles or auctions, or otherwise accessing our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and our Responsible Gaming guidelines.

If you do not agree with any provision of these terms, you must immediately discontinue use of the platform and refrain from creating an account or participating in any activities. We reserve the right to modify these terms at any time, and continued use of the platform following such modifications constitutes your acceptance of the updated terms.

2. Eligibility and Account Requirements

Participation in ELITE.GAMES services is subject to strict eligibility requirements designed to ensure compliance with Nigerian law and responsible gaming practices. You must be at least eighteen (18) years of age to create an account or participate in any raffle or auction on our platform. By registering, you represent and warrant that you meet this age requirement and that all information provided during registration is accurate, complete, and current.

You are responsible for maintaining the confidentiality of your account credentials, including your password and any authentication tokens. All activities conducted through your account are your sole responsibility, and you agree to notify us immediately of any unauthorized access or security breach. We reserve the right to suspend or terminate accounts that violate these terms, provide false information, or engage in fraudulent activity.

Account holders must complete our Know Your Customer (KYC) verification process before withdrawing winnings or accessing certain premium features. This process may require submission of government-issued identification, proof of address, and other documentation as required by Nigerian financial regulations. Failure to complete KYC verification within the specified timeframe may result in account restrictions or forfeiture of winnings.

3. Raffle Participation and Ticket Purchases

ELITE.GAMES operates a transparent and provably fair raffle system where participants purchase numbered tickets for a chance to win designated prizes. Each raffle has specific terms including ticket price, maximum ticket quantity, draw date, and prize details, all of which are clearly displayed on the raffle page before purchase. By purchasing tickets, you acknowledge that you have reviewed and accepted the specific terms of that raffle.

Ticket purchases are final and non-refundable except in cases where a raffle is cancelled by ELITE.GAMES due to technical issues, regulatory requirements, or insufficient ticket sales. In such cases, full refunds will be issued to the original payment method within fourteen (14) business days. Tickets cannot be transferred, resold, or exchanged between users unless explicitly permitted by the platform.

All raffle draws are conducted using our proprietary Provably Fair Draw System, which employs cryptographic hashing and publicly verifiable randomness to ensure complete transparency and fairness. Draw results are recorded on our blockchain-based audit trail, allowing any participant to independently verify the integrity of the selection process. Winners are notified via email, SMS, and in-app notification within twenty-four (24) hours of the draw.

4. Auction Participation and Bidding

ELITE.GAMES auctions operate on a competitive bidding model where the highest bidder at the conclusion of the auction period wins the item. Each auction listing specifies the starting bid, bid increment, reserve price (if applicable), auction duration, and item details. By placing a bid, you enter into a binding commitment to purchase the item at your bid amount if you are the winning bidder.

Bids are legally binding and cannot be retracted once submitted, except in cases of clear typographical error reported within five (5) minutes of bid placement. Bid sniping and automated bidding tools are strictly prohibited and may result in account suspension. All bids must be placed in good faith with available funds in your ELITE.GAMES wallet or verified payment method.

Winning bidders must complete payment within seventy-two (72) hours of auction conclusion. Failure to complete payment may result in forfeiture of the item, account suspension, and potential legal action to recover damages. Items are shipped or made available for collection according to the terms specified in the auction listing, with all shipping costs and applicable taxes borne by the winning bidder.

5. Payment Methods and Wallet System

ELITE.GAMES supports multiple payment methods including bank transfers, debit cards, credit cards, and mobile money services such as Paystack and Flutterwave. All transactions are processed through secure, PCI-DSS compliant payment gateways to protect your financial information. We do not store complete credit card numbers or sensitive payment credentials on our servers.

Users may maintain a ELITE.GAMES wallet balance for convenient ticket purchases and auction bidding. Wallet deposits can be made through any supported payment method, with funds typically reflecting in your account within minutes for electronic payments and up to three (3) business days for bank transfers. Wallet balances are held in Nigerian Naira (NGN) and are non-interest bearing.

Withdrawals from your ELITE.GAMES wallet require completed KYC verification and are subject to minimum withdrawal amounts and processing fees as disclosed on our platform. Withdrawal requests are processed within five (5) to seven (7) business days to the bank account registered in your name during KYC verification. We reserve the right to request additional documentation or impose withdrawal limits to prevent fraud and comply with anti-money laundering regulations.

6. Prizes and Winnings

All prizes offered through ELITE.GAMES raffles and auctions are accurately described in the respective listings, including specifications, conditions, and any applicable warranties. Physical prizes are shipped to the winner's verified address at no additional cost unless otherwise specified. For high-value items, signature confirmation and insurance may be required.

Winners are responsible for all applicable taxes, duties, and fees associated with their prizes as required by Nigerian tax law. ELITE.GAMES will issue appropriate tax documentation for prizes exceeding statutory reporting thresholds. Cash prizes and auction winnings are credited to the winner's ELITE.GAMES wallet and may be withdrawn subject to KYC verification and our standard withdrawal procedures.

Prizes must be claimed within ninety (90) days of the draw date or auction conclusion. Unclaimed prizes are forfeited and may be re-raffled, donated to charity, or retained by ELITE.GAMES at our sole discretion. Winners may be required to participate in promotional activities including photographs, testimonials, and media appearances as a condition of prize acceptance, unless prohibited by law.

7. Provably Fair System and Transparency

ELITE.GAMES is committed to operating the most transparent and verifiable raffle and auction platform in Nigeria. Our Provably Fair Draw System uses cryptographic techniques to ensure that draw results cannot be manipulated by ELITE.GAMES, participants, or any third party. Before each draw, we generate a cryptographic hash of the draw parameters and publish it publicly, creating an immutable record of the pre-draw state.

The actual draw process combines multiple sources of randomness including blockchain data, server entropy, and participant-contributed randomness to select winners. All draw parameters, random seeds, and selection algorithms are published immediately after each draw, allowing any participant to independently verify that the results were generated fairly and that the published hash matches the actual draw parameters.

Our audit trail is maintained on a distributed ledger system, providing permanent and tamper-proof records of all draws, bids, and transactions. Users can access detailed draw verification tools through our "Verify Draw" feature, which provides step-by-step instructions for independently confirming the fairness of any raffle or auction on our platform.

8. User Conduct and Prohibited Activities

Users of ELITE.GAMES must conduct themselves in accordance with applicable laws and these Terms of Service. Prohibited activities include but are not limited to: creating multiple accounts to circumvent purchase limits or eligibility requirements; using automated systems, bots, or scripts to purchase tickets or place bids; engaging in collusion, market manipulation, or other fraudulent schemes; providing false information during registration or KYC verification; attempting to reverse engineer, hack, or compromise our platform security; harassing other users or ELITE.GAMES staff; and using the platform for money laundering or other illegal purposes.

Violation of these prohibitions may result in immediate account suspension or termination, forfeiture of tickets and winnings, legal action, and reporting to appropriate law enforcement authorities. We employ sophisticated fraud detection systems and reserve the right to investigate suspicious activity, request additional verification, and withhold winnings pending investigation completion.

Users must not share, sell, or transfer their accounts to other individuals. Each account must represent a single natural person, and corporate or organizational accounts are not permitted unless specifically authorized by ELITE.GAMES for business partnerships. Any attempt to circumvent these restrictions will result in permanent account termination.

9. Intellectual Property Rights

All content on the ELITE.GAMES platform, including but not limited to text, graphics, logos, images, software, algorithms, and user interfaces, is the exclusive property of ELITE.GAMES or our licensors and is protected by Nigerian and international copyright, trademark, and intellectual property laws. The ELITE.GAMES name, logo, and all related marks are registered trademarks and may not be used without our express written permission.

Users are granted a limited, non-exclusive, non-transferable license to access and use the platform for personal, non-commercial purposes in accordance with these Terms of Service. This license does not permit you to download, copy, reproduce, distribute, modify, or create derivative works from our platform content except as necessary for normal platform use through a standard web browser.

Any user-generated content submitted to ELITE.GAMES, including reviews, comments, and testimonials, grants us a perpetual, worldwide, royalty-free license to use, reproduce, modify, and display such content for promotional and operational purposes. You represent and warrant that you own or have the necessary rights to any content you submit and that such content does not violate any third-party rights or applicable laws.

10. Limitation of Liability and Disclaimers

ELITE.GAMES provides its platform and services on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or completely secure, although we employ industry-standard security measures to protect user data and transactions. Technical issues, server maintenance, or circumstances beyond our control may occasionally affect platform availability.

To the maximum extent permitted by Nigerian law, ELITE.GAMES and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of profits, data, or opportunities, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms of Service or your use of the platform shall not exceed the amount you paid to ELITE.GAMES in the six (6) months preceding the claim.

We are not responsible for prizes that are lost, damaged, or delayed in transit when shipped by third-party carriers, although we will make reasonable efforts to assist in resolving such issues. Users are encouraged to purchase shipping insurance for high-value items. We are not liable for any tax consequences arising from prize winnings, and users are solely responsible for reporting and paying all applicable taxes.

11. Dispute Resolution and Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute, controversy, or claim arising out of or relating to these terms or your use of the ELITE.GAMES platform shall first be subject to good-faith negotiation between the parties for a period of thirty (30) days.

If negotiation does not resolve the dispute, the matter shall be submitted to binding arbitration in Lagos, Nigeria, in accordance with the Arbitration and Conciliation Act. The arbitration shall be conducted by a single arbitrator mutually agreed upon by the parties, or if no agreement can be reached, appointed by the Lagos Court of Arbitration. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

Notwithstanding the arbitration requirement, ELITE.GAMES reserves the right to seek injunctive or equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of our intellectual property rights, confidential information, or these Terms of Service.

12. Termination and Account Closure

ELITE.GAMES reserves the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms of Service, fraudulent activity, or any conduct that we determine to be harmful to the platform, other users, or our business interests. Upon termination, your right to access and use the platform immediately ceases, and we may delete your account data in accordance with our data retention policies.

Users may voluntarily close their accounts at any time by contacting customer support. Account closure requests are processed within fourteen (14) business days, during which time you may withdraw any remaining wallet balance subject to KYC verification and our standard withdrawal procedures. Unclaimed balances below the minimum withdrawal threshold may be forfeited after account closure.

Termination of your account does not relieve you of any obligations incurred prior to termination, including payment obligations for winning auction bids or compliance with our intellectual property and confidentiality provisions. Provisions of these Terms of Service that by their nature should survive termination shall remain in effect, including but not limited to intellectual property rights, disclaimers, limitations of liability, and dispute resolution provisions.

13. Modifications to Terms and Services

ELITE.GAMES reserves the right to modify these Terms of Service at any time to reflect changes in our business practices, legal requirements, or platform features. Material changes will be communicated to users via email, in-app notification, or prominent notice on our website at least thirty (30) days before the effective date of the changes, except where immediate changes are required by law or necessary to address security vulnerabilities.

Your continued use of the platform after the effective date of any modifications constitutes your acceptance of the updated Terms of Service. If you do not agree with the modifications, you must discontinue use of the platform and may close your account in accordance with our account closure procedures. We encourage users to review these terms periodically to stay informed of any updates.

We also reserve the right to modify, suspend, or discontinue any aspect of the ELITE.GAMES platform, including specific raffles, auctions, features, or services, at any time without liability. We will provide reasonable notice of significant service changes that may materially affect users' ability to participate in ongoing raffles or auctions.
